Last Updated: November 2, 2026
1. ACCEPTANCE OF TERMS
By purchasing, accessing, enrolling in, or using any digital products, masterclasses, online courses, subscriptions, memberships, downloadable materials, community forums, live webinars, or consulting/advisory services (collectively, "Services") provided through this platform by Finavator Inc. ("FINAVATOR," "Company," "we," "us," or "our"), you ("User," "Purchaser," or "Member") explicitly agree to be legally bound by these Terms and Conditions and our Privacy Policy, incorporated herein by reference. If you do not agree to every provision contained herein, you are expressly prohibited from purchasing, accessing, or using the Services.
2. DIGITAL INTELLECTUAL PROPERTY & PROPRIETARY LICENSE
All video content, audio recordings, visual frameworks, presentation slides, templates, graphics, downloadable documents, code, and proprietary strategies contained within or delivered through the Services are the sole intellectual property of FINAVATOR and are protected by international copyright, trademark, and intellectual property laws.
· Grant of License: Upon receipt of full payment, FINAVATOR grants you a single, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view the content solely for your individual personal or internal business development purposes.
· Prohibited Uses: You shall not copy, reproduce, re-sell, license, sub-license, redistribute, modify, create derivative works of, record, stream, scrape, reverse-engineer, or publicly display any portion of the Services.
· Credential Sharing: Account credentials (usernames and passwords) are strictly personal and non-transferable. Simultaneous logins or sharing credentials across multi-user environments or corporate entities without an explicit enterprise license from FINAVATOR will result in immediate termination of account access without a refund, alongside potential legal claims for damages.
3. ACCESS PERIOD, DURATION, AND PLATFORM MIGRATION
· Access Term: Digital courses, masterclasses, and digital assets are granted for the specific access timeframe explicitly advertised on the product checkout page (e.g., 365-day access or active subscription duration). Access commences immediately upon successful transaction processing.
· Platform Changes: FINAVATOR reserves the right to update, re-architect, migrate, or alter the hosting infrastructure, platform provider (e.g., Kajabi or equivalent modern LMS), or individual content structures at any time. In the event of a platform migration, FINAVATOR will maintain reasonable access pathways for active users within their valid access term.
· Live Components & Rescheduling: If the Services include live interactive sessions, Q&As, or webinars, FINAVATOR reserves the right to reschedule session dates or times due to speaker availability, technical constraints, or unforeseen circumstances without triggering a refund obligation.
4. PAYMENT TERMS, REFUND POLICY, AND CHARGEBACK PROTECTION
· Final Sale & No Refunds: Due to the immediate delivery, digital fulfillment, and non-returnable nature of online learning content and downloadable digital assets, all transactions are FINAL AND
NON-REFUNDABLE once account access or content links are delivered, unless explicitly stated otherwise in writing on the specific product checkout page.
· Immediate Fulfillment Acknowledgement: By completing your order, you explicitly acknowledge and agree that access to the digital content is made available immediately, constituting complete and irrevocable fulfillment of our obligations.
· EU/UK Consumer Waiver: If you are a consumer residing in the European Union or the United Kingdom, by completing your purchase you explicitly request that access to the digital content commences immediately, and you expressly acknowledge and agree that you waive your statutory 14-day right of withdrawal once digital fulfillment or streaming access has been initiated.
· Chargeback Defense & Dispute Penalties: You explicitly agree not to file fraudulent chargebacks, payment cancellation requests, or billing disputes with your credit card issuing bank, PayPal, Stripe, or payment gateway. In the event of an unauthorized or fraudulent chargeback initiated by the User, FINAVATOR will present these agreed-upon Terms and Conditions along with transaction IP/timestamp logs as definitive proof of service fulfillment. Furthermore, FINAVATOR reserves the right to report unpaid balances to consumer credit reporting agencies and pursue debt recovery including collection fees and reasonable legal expenses.
· Recurring Subscriptions: If enrolling in a recurring subscription or payment plan, you authorize FINAVATOR to charge your registered payment method automatically on each billing cycle until formal cancellation. You may cancel your subscription at any time prior to the next renewal billing date via your self-serve account settings dashboard.
5. AUTOMATED PURCHASING & AI AGENT TRANSACTIONS
If any purchase, agreement, or interaction with our checkout systems or platform is executed by or on behalf of an artificial intelligence agent, autonomous software bot, or third-party automated script acting on your instruction or operational directive, you (the human user or legal entity deploying said agent) remain fully bound by and financially liable under these Terms and Conditions to the same extent as if the transaction were executed manually.
6. DISCLAIMERS & LIMITATION OF LIABILITY
· Educational Purpose Only: All Services, masterclasses, and associated content provided by FINAVATOR are provided strictly for educational and informational purposes. FINAVATOR does not guarantee specific business outcomes, financial gains, revenue growth, regulatory compliance approval, or operational results as a result of implementing the methods taught.
· As-Is Basis: The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.
· Limitation of Liability: To the maximum extent permitted by applicable law, FINAVATOR, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, business disruption, or loss of data) arising out of or in connection with your use or inability to use the Services. In no event shall FINAVATOR's aggregate liability exceed the total actual amount paid by you for the specific Service giving rise to the claim.
7. FORCE MAJEURE & TECHNICAL OUTAGES
FINAVATOR shall not be held liable for any failure, delay, or disruption in delivering the Services resulting from acts of God, internet service provider outages, third-party platform failures (including LMS, database, or hosting providers), cyberattacks, power grid disruptions, or any event beyond our reasonable control.
8. MODIFICATIONS TO TERMS
FINAVATOR reserves the right to modify these Terms and Conditions at any time. Any updates will be posted on this page with a revised "Last Updated" date. Your continued access to or use of the Services following the posting of changes constitutes your binding acceptance of the updated Terms.
9. GOVERNING LAW AND EXCLUSIVE JURISDICTION
These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to conflict of law principles. You explicitly agree that any legal action, dispute, or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the courts located in Toronto, Ontario, Canada, and you hereby submit to the personal jurisdiction of such courts. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
